Legion Distribution LLC d/b/a CadNester ("CadNester," "we," "us," or "our") provides cloud-based nesting software for CNC, laser cutting, and fabrication workflows. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you visit cadnester.com, create an account, or use the CadNester service (collectively, the "Service").

1. Scope

This Privacy Policy applies to information we collect through our website, application, and related communications. It does not apply to third-party sites, services, or payment platforms that we do not control.

2. Information We Collect

A. Account Information

When you create an account, we may collect your name, email address, company name, login credentials, and subscription status.

B. Billing and Transaction Information

If you subscribe to a paid plan, payment information is collected and processed by our third-party payment processor. We may receive limited billing details such as billing contact information, subscription status, invoice history, and payment confirmation, but we do not store full payment card numbers on our own systems unless explicitly stated otherwise.

C. Customer Content

We collect files, models, layouts, metadata, settings, project names, and other content you upload or generate through the Service ("Customer Content"), including CAD and fabrication-related files such as SVG, DXF, STEP, STL, and OBJ files.

D. Usage, Device, and Log Information

We automatically collect technical information such as IP address, browser type, operating system, device identifiers, pages viewed, features used, timestamps, referring URLs, and diagnostic or error logs.

E. Cookies and Similar Technologies

We use cookies, local storage, and similar technologies to keep you signed in, remember preferences, secure the Service, and understand usage patterns.

F. Communications

If you contact us, respond to emails, request support, or otherwise communicate with us, we may collect your name, contact information, and the contents of those communications.

3. How We Use Information

We use information we collect to:

  • provide, operate, maintain, and improve the Service;
  • authenticate users and secure accounts;
  • process nesting jobs and deliver outputs;
  • manage subscriptions, billing, and customer support;
  • communicate with you about your account, service updates, or support requests;
  • monitor usage, troubleshoot issues, and detect fraud, abuse, or security incidents;
  • enforce our Terms and other policies; and
  • comply with legal obligations and protect our rights.

Where required by law, we process personal information under one or more lawful bases such as performance of a contract, legitimate interests, consent, and compliance with legal obligations.

4. How We Disclose Information

We may disclose information in the following circumstances:

A. Service Providers

We may share information with vendors and service providers that help us operate the Service, such as hosting, infrastructure, authentication, analytics, payment processing, email delivery, customer support, and security vendors.

B. Legal Compliance and Protection

We may disclose information if we believe doing so is reasonably necessary to comply with applicable law, regulation, legal process, or government request, or to protect the rights, property, safety, and security of CadNester, our users, or others.

C. Business Transfers

We do not sell or rent your Personal Information or Customer Content to third parties for their own marketing or independent commercial use. However, if CadNester or its business is involved in an actual or proposed merger, acquisition, financing, due diligence process, reorganization, bankruptcy, receivership, or sale of company stock or assets, your information and Customer Content may be disclosed to advisers and counterparties and transferred to a successor or affiliated entity as part of that transaction. Any successor may continue processing the information in accordance with applicable law and the contractual commitments then in effect.

D. With Your Direction or Consent

We may disclose information when you ask us to do so or otherwise consent.

5. No Sale of User Data for Advertising or Resale

We do not sell, rent, or trade Personal Information or Customer Content for money or for third-party advertising or marketing purposes. We also do not grant third parties the right to use your uploaded CAD files or project data for their own independent business purposes.

6. Customer Content and File Handling

You retain ownership of your Customer Content. We use Customer Content only as needed to provide the Service, maintain and secure the platform, provide support you request, investigate abuse or technical problems, and comply with legal obligations.

We do not review or access uploaded files except as reasonably necessary for those purposes.

We do not use Customer Content to train general-purpose AI or machine learning models without your explicit permission.

7. Data Retention

We keep information for as long as reasonably necessary to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, and maintain legitimate business records.

  • Account information is generally retained while your account is active.
  • Customer Content is retained until you delete it, your account is deleted, or it is otherwise removed under our retention rules.

When you delete Customer Content or your account, we will remove the data from active systems within 30 days, unless a longer retention period is required by law, needed for security or fraud prevention, or maintained in backup systems for disaster recovery purposes for a limited period.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information, including encryption in transit and other security measures appropriate to the nature of the Service. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. International Data Transfers

Your information may be processed and stored in countries other than the country where you live. By using the Service, you understand that your information may be transferred to and processed in the United States or other jurisdictions where our service providers operate, subject to applicable law.

10. Your Rights and Choices

Depending on your location and applicable law, you may have the right to:

  • access personal information we hold about you;
  • request correction of inaccurate information;
  • request deletion of your account or personal information;
  • request a copy of your information in a portable format;
  • object to or restrict certain processing;
  • withdraw consent where processing is based on consent; and
  • opt out of non-essential marketing communications.

11. Cookies and Analytics Choices

You can control cookies through your browser settings and other tools we may make available. Disabling essential cookies may affect core functionality of the Service.

12. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will take reasonable steps to delete it.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated version on this page and may also provide notice through the Service or by email. Your continued use of the Service after the effective date of the updated Privacy Policy means the updated policy will apply going forward.
